Ropeway

Article 1 (Scope of Application)

The transportation associated with the common ropeway business managed by us shall be performed in accordance with the provisions hereof. Anything not prescribed herein shall be governed by the laws and regulations and, if not prescribed in the laws and regulations, shall be governed by common practices.

Article 2 (Instructions of the Attendant)

Passengers must follow instructions of our attendant (hereinafter referred to as the “Attendant), which may be given if required for safe transportation and the maintenance of order.

Article 3 (Undertaking of Transportation)

We undertake to transport passengers unless we refuse to undertake such transportation in accordance with the provisions of Article 4 and if we restrict transportation in accordance with the provisions of Article 5.

Article 4 (Refusal to Undertake the Transportation)

We will refuse to undertake to transport a passenger for the following reasons:

  1. The passenger does not possess a valid ticket.
  2. The passenger does not follow instructions of the Attendant.
  3. A special burden is required by the passenger in relation to such transportation.
  4. Such transportation is against the provisions of laws and regulations, public order, and good morals.
  5. We believe that we cannot ensure the safety of transportation considering the passenger’s condition.
  6. The passenger possesses hazardous articles.
  7. The transportation is prevented by natural disasters or any other unavoidable reasons.
  8. There is a justifiable reason other than those prescribed in the above items.
Article 5 (Restriction on Transportation)

We may restrict the capacity of persons or the number of pieces of baggage of passengers in the event of transportation problems by natural disasters or any other unavoidable reasons.

Article 6 (Possession of Ticket)

Passengers cannot board the ropeway without a predefined ticket.

Article 7 (Sale of Tickets)

We will issue and sell the tickets at our booking window.

Article 8 (Validity of Ticket)
  1. The ticket is valid only if it is used in accordance with the conditions shown thereon.
  2. If we revise the fare or charge, the ticket sold before the revision shall remain valid during its period of validity irrespective of the amount of the fare shown thereon even after a revision of the fare.
  3. Attempts to use any ticket other than a valid ticket with the Company shall be null and void.
  4. Any ticket whose period of validity has expired shall be null and void.
  5. Attempts to use a ticket in violation of the conditions shown thereon shall be null and void.
  6. Any ticket that is badly defaced resulting in the conditions shown thereon being illegible or any ticket that is intentionally altered or forged by a passenger or any other person or any transcribed, copied, digitalized, or other similar ticket shall be null and void.
  7. Resale of tickets is prohibited. Any resold ticket shall be null and void and shall be expropriated.
Article 9 (Confirmation and Presentation of Ticket)

At the time of boarding, the ticket shall become non-refundable at the entrance gate. We may ask a passenger to show the ticket and may check the ticket shown by the passenger.

Article 10 (Fares, Charges and Manner of Application)

Fares and charges that will be received by us from passengers and the manner of application shall be governed by the fare table separately shown and the manner of application separately provided, which were filed with and accepted by the director of the Hokkaido District Transport Bureau and are in effect.

Article 11 (Treatment of Passengers during Transportation in the Event of Cessation of Operation)

If we cannot operate the ropeway or if we cease operation due to natural disasters or other unavoidable reasons, we will take the necessary precautions to keep transporting passengers, including alternative transportation.

Article 12 (Extra Fare, etc.)

If either of the situations stated below applies to a passenger, we will claim the extra fare or extra charge in addition to the ordinary fare or ordinary charge with the same conditions as those for a ticket in the possession of such passenger in accordance with the regulations separately provided.

  1. Such passenger uses a ticket that has become null and void in accordance with the provisions of Article 8.
  2. Such passenger uses a ticket as a means of an illegal ride.
Article 13 (Refund of Fare)

1. If we cannot operate the ropeway due to natural disasters or our fault, we will refund the fare in accordance with the regulations separately provided only within the validity period of ticket, except for a temporary cessation of operation due to possible hazards in the operation of ropeway due to wind, rain, snow, fog, thunder, earthquake, or electric failure.

  1. In the event of the preceding paragraph, the fare shall be refunded on a 10-yen basis and any fraction less than 10 yen that may accrue from the calculation shall be rounded to the nearest 10.
  2. In no event will we refund the fare if a passenger travels one way with a round-trip ticket and requests a refund for the remaining one-way fare at his/her own convenience.
Article 14 (Place where the Fare is Refunded)

We will refund the fare in accordance with the provisions of the preceding article at the booking window referred to in Article 7.

Article 15 (Loss of Tickets)

If a passenger has lost a ticket and the Attendant cannot recognize the loss, the passenger must purchase a new ticket.

Article 16 (Times when the Responsibility Commences and Ends)

Our responsibility for transportation shall commence when a passenger gets on a carrier and shall end when a passenger gets off.

Article 17 (Liability for the Life and Body of Passengers)

If a passenger’s life or body is damaged because of our operation of the ropeway, we will be liable for compensating for such damage whereby incurred, except for the following reasons:

  1. It is certified that we did not fail to take the due care provided by law in relation to the operation of the ropeway and that there was no defect or malfunction in the ropeway facilities.
  2. It is certified that the accident was caused solely by willful intent or negligence of a third party other than the passenger and the Attendant.
Article 18 (Exemption from the Responsibility for Personal Effects of Passengers and Other Claims)

1. We will not be liable for compensating for damage due to the loss or destruction of personal effects arising in connection with by the transportation of passengers, except if such loss or destruction is caused by our negligence.

  1. If the inability of or delay in operation takes place or the passengers cannot board due to mechanical failure, we will not assume any liability for direct or indirect damage to passengers or other applicants, irrespective of whether or not such situations are caused by reasons attributable to us, except as prescribed in Article 13, and the passengers and other applicants shall not lodge any claim against the Company.
Article 19 (Liability of Passengers)

If the Company suffers from damage due to willful intent or negligence or noncompliance with the provisions hereof by a passenger, we may claim compensation for such damage from such passenger.

Article 20 (Jurisdiction)

Any dispute with respect to the use of our ropeway facilities shall be submitted to a competent court having jurisdiction over the location of our ropeway facilities.
